1. General provisions relating to these general conditions of sale

These general terms and conditions of sale, hereinafter the “GTC”, apply to all orders placed on the website at the address motoblouz, hereinafter the "Site," published by the company D3T DISTRIBUTION, hereinafter "MOTOBLOUZ," a simplified joint-stock company with a capital of €9,195.00, registered with the RCS of Arras (France) under number 478 566 250, with its registered office at 72 rue Elie Cartan, zone artisanale de la Gare d’Eau 62220 CARVIN, represented by Mr. Jérôme Dalidet.
The General Terms and Conditions are made available to Internet users, visitors or Customers, on the Site where they can be consulted directly and can also be communicated to them upon simple request by any means.
By registering on the Site, the Customer confirms having read the GTC and accepts them, making them contractually bound by their terms. MOTOBLOUZ reserves the right to adapt or modify the GTC at any time. In case of modification, the GTC in effect on the day of the order will apply to each order.
MOTOBLOUZ reserves the right to modify at any time and without notice the content of the Site or the services available there, and/or to temporarily or permanently cease operating all or part of the Site.

2. Our offer

All offers of products, services and delivery methods, at prices indicated in Euros, are valid in the territories of the Member States in which MOTOBLOUZ markets its products, within the limits of available stocks.
The VAT rate applied varies depending on the country where the order is placed.
For orders outside the European Union, the products will be invoiced to you excluding taxes and you will have to pay the shipping costs calculated according to the country of destination and the weight of the package. Upon receipt of the package, you will have to pay customs duties and local VAT according to the country of destination. The amount of the shipping costs will be indicated to you when choosing the delivery method.

A description with the essential characteristics of the product is present on each item that we sell. However, some minimal variations may occur, which is why it is recommended to attach our customer service if in doubt.
The photographs illustrating the products and their description do not constitute a contractual document.
Our teams do what is necessary to render a faithful image of the products offered for sale by the images or photographs used for their presentation. Variations may nevertheless appear in particular due to technical limitations, color rendering or customer equipment (internet browser, screen used). Motoblouz therefore recommends that the customer refer to the description of the products appearing on the site to know their essential characteristics.
Except in the case of a guarantee (see article 10 below), any transaction between Motoblouz and its customers, not contested within 14 days following delivery, cannot give rise to a claim.

3. Creation of a customer account

To place an order on the Site, the Customer must first create their personal customer account. Once created, to access it, the Customer must log in using their personal and confidential username and password.
Each Customer undertakes to maintain strict confidentiality of the data, in particular the username and password, allowing them to access their customer area, the Customer acknowledging that they are solely responsible for accessing the service using their username and password, except in the case of proven fraud.
Each Customer further undertakes to inform MOTOBLOUZ without delay in the event of loss, misappropriation or fraudulent use of their username and/or password.
After creating his personal customer area, the Customer will receive an email confirming the creation of his customer area. The Customer undertakes when registering to:
- provide real, accurate, up-to-date information at the time of entry in the service registration form, and in particular not to use false names or addresses, or names or addresses without authorization
- keep registration data up to date to ensure that it is always real, accurate and up to date
The Customer further undertakes not to make available or distribute illicit or reprehensible information (such as information constituting identity theft) or harmful information (such as viruses). Otherwise, MOTOBLOUZ will be able to suspend the Customer's access to the Site at its exclusive fault.
The Customer acknowledges that the characteristics and constraints of the Internet do not guarantee the security, availability and integrity of data transmissions on the Internet.
Thus, MOTOBLOUZ does not guarantee that the Site and its services will operate without interruption or malfunction. In particular, its operation may be temporarily interrupted for maintenance, updates or technical improvements, or to develop its content and/or presentation. MOTOBLOUZ cannot be held responsible for the use that would be made of the Site and its services by Customers in violation of these General Terms and Conditions and for any direct or indirect damage that this use could cause to a Customer or a third party.
In particular, MOTOBLOUZ cannot be held responsible for false declarations made by a Customer.
In the event that MOTOBLOUZ 's liability is sought due to such a fault by one of its Clients, the latter undertakes to guarantee MOTOBLOUZ against any conviction pronounced against it as well as to reimburse it for all costs, in particular representation to assert its rights before the Courts.

4. Order

The order can only be registered on the site if you have clearly identified yourself either by entering your username and password, which are strictly personal to you, or by creating an account on the website motoblouz if you are not yet registered.
Any order implies acceptance of the prices and description of the products available for sale. The contract is formed when your order confirmation is issued. As soon as your order is validated, it will be sent to our logistics services for processing. You will receive an premier automatic acknowledgment email within the hour.
We remind you that validating an order implies the obligation to pay the price indicated.

5. Price

Prices are indicated in euros (€) and take into account the country's VAT in force.
In the event of a promotion, MOTOBLOUZ undertakes to apply the promotional price to any order placed during the period covering the promotion.
The full price is due after order confirmation. Prices shown include any discounts and rebates that MOTOBLOUZ may offer.
If delivery or transport costs apply (see article 7 below), they will be added to the price of the order and indicated separately before its validation by the Customer. The total amount owed by the Customer and its details are indicated on the confirmation page of each order.

6. Payment and security

6.1 BY BANK CARD
Payment is made on the secure payment interface of our partner Glopal when ordering on motoblouz . Payment by credit card is perfectly secure. Motoblouz certifies that it does not hold any banking information entered during the ordering process. All banking details are transmitted in real time to our partner Glopal. For purchases made on the web, your account is debited when your order is validated.
Payment security: your credit card details are encrypted using the TLS (Transport Layer Security) protocol and are never transmitted in clear text over the network. Payment is made directly to the bank. Motoblouz has no access to these details and does not store them on its servers. This is why you are asked for them again for each new transaction on our site.
6.2 RETENTION OF TITLE CLAUSE
The products remain the property of MOTOBLOUZ until full payment of the order by Motoblouz . However, from the time of delivery, the risks of the delivered goods are transferred to the customer.
6.3 DEFAULT OF PAYMENT
MOTOBLOUZ reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid for a previous order or with whom a payment dispute is currently being administered.
6.4 ANTI-FRAUD CONTROL
Securing your orders on Motoblouz is a major concern. This is why orders are checked before shipping.
As part of this control and in order to combat fraud and the usurpation of means of payment on the Internet, Motoblouz may ask the customer to provide proof of identity and address. Depending on the date of receipt, the shipping time of your order may be extended.
If the check of these documents proves favorable, the order will be validated. Otherwise or in the case of non-receipt, Motoblouz reserves the right to cancel the order. It would then be canceled and then refunded.


7. Terms and delivery times

Processing Time: Your order will be carefully packed and prepared for shipping within 3 business days.
Shipping Time: Due to global shipping logistics and customs processing, your package may take approximately 20-30 business days to reach its destination.

8. Right of withdrawal

In accordance with Directive 2011/83/EU of 25 October 2011 on consumer rights transposed into the national legislation of the Member States, you have a period of 14 calendar days from receipt of your items to exercise your right of withdrawal without having to justify your decision or bear other costs.
In the case of an order for several items delivered separately, the period starts from receipt of the last item.
To exercise your right of withdrawal, you must notify the company D3T DISTRIBUTION of your decision either by means of the withdrawal form, duly completed, presented below in the General Conditions of Sale, or by any unambiguous correspondence expressing your desire to withdraw:

For any additional information on the terms of exercising your right of withdrawal, you can contact us via the contact form on the website motoblouz .
In the event of exercising the right of withdrawal, we will reimburse the sums paid, including the cost of delivery:
- at the latest within 14 days from the date on which we are informed of your decision to withdraw, this date being however deferred until receipt of the returned item(s) or proof of their shipment, the date retained being that of the premier of these facts ;
- using the same means of payment as that used at the time of the order, unless another means of reimbursement is agreed between the parties.
We inform you that if you have chosen a more expensive delivery method than the standard delivery method, the delivery costs will be refunded to you up to the cost of standard delivery.
You are required to return or restore the item(s) within 14 days of communicating your decision to withdraw, the return shipping costs being your responsibility.


9. Product return conditions (excluding legal or commercial guarantees)

9.1 when to return the product?
You have 60 days from the date of receipt to return the items to us for a refund.
9.2 how to return the product?
Return the item in the box in which it was sent to you or in an identical box (reinforced, same size) if the premier has been damaged. Please note that commercial packaging is not made for transporting goods. In order to preserve the original box of the item, the return must be made by packing it in an over-cardboard as in the initial shipment.
9.3 conditions for your return to be accepted?
You have 60 days from the date of receipt to return the items to us for a refund.
Items must be unused, in their original packaging and must have tags attached. Some products cannot be returned: custom, personalized, perishable or edible items.
If these products are returned, we will reship them. If they are returned again, we reserve the right to keep them without refund.
Return of damaged or incorrect items must be approved by our Customer Service.
If the item is damaged, incorrect, or not compatible, your return shipping costs will be refunded if your request is approved.
We reserve the right not to accept the return of defective items without an approved claim.
If you would like a new item, please return the item you received for a refund. You will then need to place a new order. The shipping costs for the second shipment and the return shipping costs are not refundable.
Please note: The After-Sales Service reserves the right to refuse the return if one of the conditions is not respected, the package will then be returned directly to you.
9.4 how to make your return request?
Find the order history for the item in question (it must be less than 60 days old). The process will be explained to you step by step, but be sure to print the summary to attach to your package.
The return of item(s) is carried out by your own means, the cost being at your expense.
You are invited to specify, where applicable on any document from the customs authorities, that this is a return of product(s), in order to avoid having to bear additional taxes.


10. Product Warranty

10.1 COMMERCIAL GUARANTEE
The products sold are covered by a commercial guarantee aimed at guaranteeing their conformity and ensuring the reimbursement of the purchase price or the repair of the goods. It does not cover defects caused by abnormal or faulty use or resulting from a cause external to the intrinsic qualities of the products or defects mentioned on the product sheet in the context of "second choice/reconditioned" products.
Information concerning any commercial guarantees relating to the products and services offered for sale (in particular the content of the guarantee, the terms of its implementation, its price, its duration, its territorial scope as well as the name and address of the guarantor according to the products, services and brands concerned) are brought to the attention of the customer where applicable on the sheet for each product and service in the online sales area.
10.2 LEGAL GUARANTEE
Independently of the commercial guarantee presented above, the products benefit from the legal guarantee of conformity defined in EU Directive 2019/771 of May 20, 2019 relating to certain aspects concerning contracts for the sale of goods, transposed into the national legislation of the States members.
When you act within the framework of the legal guarantee of conformity, you benefit from a period of two (2) years from the delivery of the goods to act

At any time, and in application of articles 15 to 21 of the General Data Protection Regulation, you have the right to access, rectify, erase, limit processing, portability and object.

12. Completeness

These general conditions of sale constitute the contract governing the relations between the Customer and MOTOBLOUZ .
They constitute all of the rights and obligations governing these relationships.
If one or more provisions of these general terms and conditions of sale were declared null and void pursuant to a law, regulation or following a final decision by a court, the other provisions shall retain their full force and scope.
Furthermore, the fact that one of the parties does not avail itself of a breach by the other party of any of the stipulations of these general conditions of sale cannot be interpreted as a waiver on its part to avail itself of them subsequently.


13. Dispute resolution

These general terms and conditions of sale are subject to the national law of the Member State defined in accordance with the provisions of EC Regulation No. 593/2008 of 17 June 2008 on the law applicable to contractual obligations, particularly its Article 6.
Any claim related to the execution or interpretation of the contract must first be submitted in writing to the customer service department of D3T DISTRIBUTION, either by email by clicking on this link, or via the contact form accessible on the website motoblouz.
In addition and in accordance with Article 14 of Regulation (EU) No. 524/2013 of 21 May 2013 on online dispute resolution for consumer disputes, MOTOBLOUZ informs you that the European Commission has set up a platform intended to collect consumer complaints following an online purchase in order to then forward them to the competent national mediators.

Any dispute or litigation arising from the execution or interpretation of these general terms and conditions of sale, which has not been amicably resolved by the parties, will be subject to the jurisdiction of the Court established in accordance with the rules of civil procedure defined in EU Regulation No. 2015/20212 of December 12, 2012, in particular relating to judicial jurisdiction, particularly its Article 7.
